Monthly Nishikigoi Terms of Use Terms of Use (referred to as "the Terms") stipulate the conditions for providing this service and the rights and obligations between our company and users. Amendment of the Terms of Use 1. Our company retains the authority to amend the service content or the terms and conditions as deemed necessary without obtaining prior consent from users. 2. If our company amends the terms, we will notify users of the effective date and content of the revised terms on this website for public awareness. 3. Except in cases where the fault lies with our company, we shall not be liable for any damages incurred by users due to modifications made to the terms. 5. Registration and Duration 1. Books within this service will be available for three years, after which they will be removed. 8. When a former general member who has previously cancelled their annual subscription plan renews it, they cannot access books from the period they were previously subscribed. 6. Notification of Changes 1. Users are required to promptly inform our company of any changes to their user registration information using the method designated by our company. 7. Maintenance of the usage environment for this service 1. Users are responsible for ensuring and maintaining the necessary conditions for using the service, including their internet environment, at their own cost and discretion. Users are obligated to comply with laws and regulations regarding the use of this service. 10. Fees and Payment Methods 1. No refunds will be issued if a user subscribed to the annual subscription plan cancels during the subscription period. 11. Management of User IDs, Email Addresses, and Passwords 1. Users are prohibited from engaging in or performing activities our company deems to fall under any of the following items when using this service. (1) Acts that violate laws or are associated with criminal activities (2) Fraud or extortion towards our company, other users of the service, or any other third parties. (3) Acts contrary to public order and morals. (4) Actions that infringe upon intellectual property rights, portrait rights, privacy rights, honour, or other rights or interests of our company, other users of this service, or any other third parties. (5) Actions that place an excessive load on the network or systems of this service. (6) Reverse engineering or other analysis activities on our company's software or other systems. (7) Actions that may hinder the operation of this service. (8) Unauthorized access to our company's network or systems. (9) Impersonation of a third party. (10) The act of using the ID or password of another user of this service. (11) Advertising, promotion, solicitation, or commercial activities on this service without prior approval from our company. (12) Collect information from other users of this service. (13) Acts that cause harm, damage, or discomfort to our company, other users of this service, or any other third parties. Assignment 1. Users are prohibited from transferring, assigning, pledging, or otherwise disposing of their position under this service agreement or rights and obligations based on these Terms to a third party without prior written consent from our company. 2. If our company transfers the business related to this service to another company, our company may transfer the user's position under this service agreement, rights and obligations based on the Terms, as well as the user's registration and other customer information, to the transferee of such business transfer. The user consents in advance to the transfer as described herein. Additionally, the business transfer mentioned in this provision encompasses standard business transfers and any instances where business operations are transferred through company divisions or alternative methods. 24. Governing Law and Jurisdiction 1. The laws of Japan govern the interpretation of the terms. 2. If a user violates any prohibited activities as stipulated in the Terms and engages in fraudulent or illegal activities resulting in damages to third parties or us, the user shall be liable to compensate for all such damages (including legal fees and expenses incurred by us with third parties). 22. Separability 1. If any provision or part of a provision of the Terms is determined to be invalid or unenforceable under the Consumer Contract Act or any other relevant laws, the remaining provisions of the Terms and any remaining portion of the provision determined to be invalid or unenforceable shall remain in full force and effect. 2. If any provision or part of a provision of the Terms is deemed invalid or unenforceable under the Consumer Contract Act or any other applicable laws, both our company and the user shall endeavour to agree on modifications to the invalidated portion to achieve the intended purpose or legal and economic effects sought to be achieved through the provision, to the extent possible 23. Assignment 1. Users are prohibited from transferring, assigning, pledging, or otherwise disposing of their position under this service agreement or rights and obligations based on these Terms to a third party without prior written consent from our company. 2. If our company transfers the business related to this service to another company, our company may transfer the user's position under this service agreement, rights and obligations based on the Terms, as well as the user's registration and other customer information, to the transferee of such business transfer. The user consents in advance to the transfer as described herein. Additionally, the business transfer mentioned in this provision encompasses standard business transfers and any instances where business operations are transferred through company divisions or alternative methods. 24. Governing Law and Jurisdiction 1. The laws of Japan govern the interpretation of the terms. 2. 月刊錦鯉利用規約 本利用規約（以下「本規約」と言います。）には、本サービスの提供条件及び当社とユーザーの皆様との間の権利義務関係が定められています。本サービスの利用に際しては、本規約の全文をお読みいただいたうえで、本規約に同意いただく必要があります。 第１条 （適用） 本月刊錦鯉利用規約（以下「本規約」といいます。）は、株式会社錦彩出版（以下「当社」といいます。）が提供する当社ウェブサイトにおいて一般社団法人全日本錦鯉振興会の認定機関誌である「月刊錦鯉」の電子版を閲覧するサービス（以下「本サービス」といいます。）に関し、本サービスを提供・運営する当社と、本サービスを利用するユーザー（第 2 条において定義します。）の間における権利義務関係を定めることを目的とし、本サービスの利用にかかる一切の取引・関係に適用されます。 当社が当社のウェブサイトまたはユーザーに対して電子メール等で発信する個別規定は、本規約の一部を構成するものとし、以下本規約内において特段の表示のない限り、これらを含むものとします。 本規約の内容と、ルールその他の本規約外における本サービスの説明等とが異なる場合は、本規約の規定が優先して適用されるものとします。 第２条 （定義） 本規約における次の用語はそれぞれ次の意味で使用します。 「ウェブサイト」：一般社団法人全日本錦鯉振興会の認定機関誌である「月刊錦鯉」の電子版の閲覧サービス提供を行うウェブサイト（以下、本ウェブサイトといいます）をいいます。 「コンテンツ」：「月刊錦鯉」の電子版をいいます。 「ユーザー」：本サービスを利用するために本規約に同意してユーザー登録を行い、本サービスを利用する権限を付与された者をいいます。なお、ウェブサイトを使用するユーザー種類は一般社団法人全日本錦鯉振興会員、年間購読プランに加入した一般会員、一部書籍のみを購入した一般会員、何も購入していない一般会員があります。 「個人情報」：個人に関する情報であって、記述により特定の個人を識別することができるもの（他の情報と容易に照合することができ、それにより特定の個人を識別することができるもの）をいいます。 「知的財産権」：著作権、特許権、実用新案権、意匠権、商標権その他の知的財産権（それらの権利を取得し、またはそれらの権利につき登録等を出願する権利を含みます。）をいいます。 第３条 （本サービスの目的） 本サービスは、電子媒体によるコンテンツをユーザーに提供し、錦鯉産業の情報を広く・正しく発信させることを目的とします。 第４条 （利用規約等の変更） 当社は、当社が必要と判断した場合は、あらかじめユーザーの承諾を得ることなく、本サービスの内容又は本規約を変更することができるものとします。 当社が本規約を変更する場合、変更後の本規約の施行時期及び内容を本ウェブサイトにおいて掲載することにより周知するものとします。 当社は、当社の責めに帰すべき事由がある場合を除き、本規約の変更によりユーザーに生じた一切の損害について、責任を負いません。 第５条 （登録・期間） 本サービスの利用を希望する者（以下「登録希望者」といいます。）は、本規約を遵守することに同意し、かつ当社の定める一定の情報（以下「登録事項」といいます。）を当社の定める方法で当社に提供することにより、当社に対し、本サービスの利用の登録を申請することができます。 前項に基づく申し込みがあった場合、当社は、当社の定める基準により審査し、当該登録希望者の登録の可否を決するものとします。登録申請者のユーザーとしての登録は、当社の登録可否判定をもって完了したものとします。 前項に定める登録の完了時に、サービス利用契約がユーザーと当社の間に成立し、ユーザーは本サービスを利用することができるようになります。 当社は、登録申請者が、以下の各号のいずれかの事由に該当する場合は、登録及び再登録を拒否することがあり、またその理由について一切の開示義務を負いません。 当社に提供した登録事項の全部または一部につき、虚偽、誤記または記載漏れがあった場合 第１２項目に定める措置を受けたことがある場合 その他、登録を適当でないと当社が判断した場合 年間購読プランの有効期間は利用料の決済日から起算して1年間とし、ユーザーから解約の申し出が無い限りは1年ごとの自動更新とします。 年間購読プランで閲覧できる書籍は利用料の決済日から起算して1年間の期間内に発行された書籍とします。また、初回の利用料の決済日以降に発行された書籍についても年間購読プランを継続している限り閲覧できるものとします。 本サービスにおける書籍の公開期間は3年間分とし、公開期間が過ぎたものは本サービスから削除するものとします。 年間購読プランを解約済の一般会員が再度年間購読プランを契約した際、過去に契約していた期間の書籍は閲覧できません。 第６条 （変更の届出） ユーザーは、ユーザー登録情報に変更が生じた場合は、当社所定の方法により、当社に対し、速やかに変更内容を届け出るものとします。 第７条 （本サービスの利用における機密の保持） ユーザーは、コンテンツ及び当社の非公知の秘密情報を機密として保持し、本サービスの利用目的以外には使用せず、第三者に開示、漏えいしないものとします。 第８条 （本サービスの利用環境の整備） ユーザーは自らの負担により、自らの責任において、インターネット通信環境等、本サービスを利用するのに必要な環境を整え、保全するものとします。本サービスを利用する際のセキュリティ環境についてもユーザー自身の負担と責任において確保するものとします。 第９条 （ユーザーの責任） ユーザーは本サービスの利用に関し、法令を遵守する義務を負います。 第１０条 （料金及び支払い方法） ユーザーは本サービスの利用に関し、法令を遵守する当社が別途定める価格表に基づき、当社に対し利用料を支払うものとします。 年間購読プラン加入ユーザーが期間中に解約した際、料金は返金されないものとします。 第１１条 (ユーザーID、メールアドレス及びパスワード の管理) ユーザーは、自己の責任において、本サービスに関するパスワード及びユーザーIDを適切に管理及び保管するものとし、これを第三者に利用させ、または貸与、譲渡、名義変更、売買をしてはならないものとします。 パスワードまたはユーザーID の管理不十分、使用上の過誤、第三者の使用等によって生じた損害に関する責任は登録ユーザーが負うものとします。 第１２条 （禁止事項） ユーザーは、本サービスの利用にあたり、以下の各号のいずれかに該当する行為または該当すると当社が判断する行為を禁止します。 法令に違反する行為または犯罪行為に関連する行為 当社、本サービスの他の利用者またはその他の第三者に対する詐欺または脅迫行為 公序良俗に反する行為 当社、本サービスの他の利用者またはその他の第三者の知的財産権、肖像権、プライバシーの権利、名誉、その他の権利または利益を侵害する行為 本サービスのネットワークまたはシステム等に過度な負荷をかける行為 当社が提供するソフトウェアその他のシステムに対するリバースエンジニアリングその他の解析行為 本サービスの運営を妨害するおそれのある行為 当社のネットワークまたはシステム等への不正アクセス 第三者に成りすます行為 本サービスの他の利用者の ID またはパスワードを利用する行為 当社が事前に許諾しない本サービス上での宣伝、広告、勧誘、または営業行為 本サービスの他の利用者の情報の収集 当社、本サービスの他の利用者またはその他の第三者に不利益、損害、不快感を与える行為 当社ウェブサイト上で掲載する本サービス利用に関するルールに抵触する行為 反社会的勢力等への利益供与 その他、当社が不適切と判断する行為 第１３条 （登録情報等の利用） 当社は、ユーザー登録情報を含め本ウェブサイトの利用・閲覧履歴その他本サービスの利用に関し生成または蓄積された情報を収集できるものとし、これらの情報のうち、ユーザーを特定・識別することのできない様に加工した情報については、ユーザーの承諾がなくとも、利用することができるものとします。 第１４条 （個人情報等の取り扱い） 当社は、本サービスの利用に際して、ユーザーから取得した氏名、メールアドレス、住所、電話番号等の個人情報、その他本サービスの利用に関する情報を、本規約に定める他、当社が別途定めるプライバシーポリシーに基づき、適切に取り扱うものとします。 ユーザーは、本サービスの利用に際して得た個人情報については本サービスの目的に従って利用し、適切に管理するものとします。 第１５条 （権利帰属） 本サービスにかかるコンテンツ提供者が作成したコンテンツ以外のすべてのデータ、ソフトウェア、資料等（以下「データ等」といいます。）に関する所有権、知的財産権その他一切の権利は、当社に帰属します。 本サービスにおける全てのデータ等の複製並びに再配布を禁止します。 当社がユーザーに対して行う、ユーザー登録に基づく本サービスの利用許諾は、当社の保有する知的財産権その他一切の権利（以下「知的財産権等」といいます。）について、使用または利用を許諾するものではありません。ただし、本規約に定めのある場合または別途合意のある場合は、この限りでありません。 ユーザーは、いかなる理由によっても、本規約に定めのある場合または別途合意のある場合を除き、当社またはデータ等権利者の保有する所有権、知的財産権等に対し、これを侵害する行為またはそのおそれのある行為をしてはなりません。 第１６条 （免責および補償） 当社は、本サービスがユーザーの特定の目的に適合すること、期待する機能・商品的価値・正確性・有用性・最新性・確実性を有すること、ユーザーによる本サービスの利用がユーザーに適用のある法令または業界団体の内部規則等に適合すること、継続的に利用できること、及び不具合が生じないことについて、明示又は黙示を問わず何ら保証するものではありません。 当社は、本サービスの確実な提供またはアクセス結果等につき何ら保証するものではありません。 ユーザーは、本サービス提供に要する外部サービス（以下「外部サービス」といいます）のサービス内容、運用の変更により、又はユーザーが外部サービスの全部若しくは一部を利用できなくなることにより、本サービスの全部又は一部の利用ができなくなる場合があることを予め了承するものとします。当社は外部サービスに関連してユーザーに発生した損害について、一切の責任を負わないものとします。 本サービスまたは当社ウェブサイトに関連してユーザーと他のユーザーまたは第三者との間において生じた取引、連絡、紛争等については、ユーザーが自己の責任によって解決するものとします。 当社は、本サービスに関してユーザーが被った損害につき、過去１２カ月間にユーザーが当社に支払った対価の金額を超えて賠償する責任を負わないものとし、また、付随的損害、間接損害、特別損害、将来の損害及び逸失利益にかかる損害については、賠償する責任を負わないものとします。 第１７条 （内容の変更、終了） 当社は、当社の都合により、本サービスの内容を変更し、または提供を終了することができます。 当社が本サービスの提供を終了する場合、当社はユーザーに事前に通知するものとします。 第１８条 （本サービスの停止等） 当社は、次の各号のいずれかの事由に該当する場合には、ユーザーに事前に通知することなく、一時的に本サービスの一部の提供を停止または中断できるものとします。 本サービスの提供のためのシステムまたは関連設備の保守を定期的または緊急に行うとき 当社が利用する通信回線、電力等の提供が中断されたとき 火災、停電等により本サービスの提供ができなくなったとき 地震、台風、洪水、津波等の天災その他の非常事態が発生した場合、またはそのおそれが生じたために、法令・指導により通信の制限等の要請、指示があったとき その他、当社が停止または中断を必要と判断した場合 当社は、本サービスの提供の遅滞または一時的な中断が発生したとしても、これに起因して、ユーザーまたは第三者が被った損害について、当社の責めに帰すべき事由がある場合を除き一切責任を負わないものとします。 第１９条 （登録抹消等） 当社は、ユーザーが、以下の各号のいずれかの事由に該当する場合は、事前に通知または催告することなく、データを削除もしくは非表示にし、当該ユーザーについて本サービスの利用を一時的に停止し、またはユーザーとしての登録を抹消することができます。 本規約のいずれかの条項に違反した場合 登録事項に虚偽の事実があることが判明した場合 支払停止もしくは支払不能となり、または破産手続開始、民事再生手続開始、会社更生手続開始、特別清算開始若しくはこれらに類する手続の開始の申立てがあった場合 当社からの問い合わせその他の回答を求める連絡に対して 30 日間以上応答がない場合 その他、当社が本サービスの利用またはユーザーとしての登録の継続を適当でないと判断した場合 第２０条 （利用の終了） ユーザーは、当社所定の方法に従って、当社に利用終了の申入れを行うことにより、本サービスの利用を終了することができるものとします。 なお、ユーザーが利用終了の申入れを行う際は当社へ連絡を行った上で、当社がユーザーを削除することで本サービスの利用を終了するものとします。 利用終了の申し入れがあった場合、当社所定の方法に基づく利用終了手続が完了した時点をもってユーザーの資格を失うものとし、当該利用終了手続が完了した日を利用終了日とします。 当社は、ユーザーが本条に基づき本サービスの利用を終了した場合、当該ユーザーに関するユーザー提供情報等の全部または一部について、消去等の措置をとることができるものとします。 当社は、本条に基づく退会または情報の削除によって、利用の終了の申し入れを行ったユーザーに生じた一切の損害について責任を負いません。 第２１条 （違約金および損害賠償等） ユーザーが本規約等に定める禁止事項に違反し、または、不正もしくは違法な行為を行ったことにより当社または第三者に損害が生じた場合、ユーザーはその一切の損害（弁護士費用、当社が第三者に対し負担した費用を含む）を賠償する責任を負います。 第２２条 （分離可能性） 本規約のいずれかの条項の全部または一部が、消費者契約法やその他の法令等により無効または執行不能と判断された場合であっても、本規約の残りの条項および一部が無効または執行不能と判断された規定の残りの部分は、完全に有効であるものとします。 当社とユーザーとは、本規約のいずれかの条項の全部または一部が、消費者契約法やその他の法令等により無効または執行不能と判断された場合であっても、無効となった条項の全部または一部により達成しようとした目的や法的、経済的な効果を達成するために、無効となった部分について、有効な内容への改定に変更して合意するよう努めるものとします。 第２３条 （譲渡） ユーザーは、当社の書面による事前の承諾なく、利用契約上の地位または本規約に基づく権利もしくは義務につき、第三者に対し、譲渡、移転、担保設定、その他の処分をすることはできません。 当社は本サービスにかかる事業を他社に譲渡した場合には、当該事業譲渡に伴い利用契約上の地位、本規約に基づく権利及び義務並びにユーザーの登録事項その他の顧客情報を当該事業譲渡の譲受人に譲渡することができるものとし、ユーザーは、かかる譲渡につき本項において予め同意したものとします。なお、本項に定める事業譲渡には、通常の事業譲渡のみならず、会社分割その他事業が移転するあらゆる場合を含むものとします。 第２４条 （準拠法と裁判管轄） 本規約の準拠法は日本法とします。 本規約から生じるもしくは本規約に関連するあらゆる紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。 最終更新日：2024年2月22日
